Language and Interpretation
This localized document is provided so users can understand Mulbyul in their preferred language. It is written as service-ready legal copy for this locale, not as a word-for-word translation.
If this localized document conflicts with the Korean version, the Korean version will govern to the extent permitted by applicable law. Nothing in this document limits mandatory consumer, privacy, or safety rights that cannot be waived under local law.
Important Safety Notice
Mulbyul is a general wellness support tool that helps with freediving dry-training routines and records. Mulbyul is not a medical device, safety equipment, rescue equipment, emergency alert service, professional coaching service, or diving safety guarantee.
Training that involves breath holding and possible low-oxygen states can involve dizziness, hyperventilation, hypoxia, fainting, blackout, falls, injury, and death. Users must check their own health condition and training environment and must not use the app in dangerous or uncontrolled environments.
Mulbyul must not be used in water, pools, bathtubs, beaches, diving sites, while driving, operating machinery, at heights, on roads, while walking or running, or in places where the user cannot respond to danger alone.
1. Purpose
These Terms define the conditions for using the Mulbyul app provided by InnoSquad, the rights and obligations of users and the company, dry-training safety notices, data and record handling, liability limits, and dispute prevention and response standards.
2. Service
Mulbyul provides routines, timers, step-by-step progress, session records, heart rate reference display, Apple Watch and HealthKit integration, AI routine generation, app settings, and document guidance for freediving dry training. External platform integrations such as Apple Watch, HealthKit, and iCloud may be limited depending on the user's device, OS, permissions, and account settings.
Mulbyul routines, durations, repetitions, heart rate display, record charts, and AI-generated results are reference information to support training. They do not guarantee the user's health condition, diving qualification, safety ability, training suitability, competitive results, or any specific outcome.
2-1. Platform Scope, Storage, and Backup
Mulbyul is available on Web, Android and Wear OS, and Apple platforms. Features may differ by device, OS, permission, account, storage, and release version. The Web app currently has no account or automatic cloud sync and stores routines, records, and settings in IndexedDB and other browser storage for the current site origin.
Web data may disappear when browser site data is cleared, private browsing is used, storage is restricted, or the site origin changes. Users should create manual backups when needed. A .mulbyulbackup file is a binary format for compatible apps, not a password-encrypted secure vault, so users are responsible for its storage, sharing, and deletion.
Heart rate, HealthKit, Wear OS sensors, advertising, analytics, iCloud, and device integrations may be available only on relevant platforms or may be limited by permission and region. Web requests may pass through Cloudflare for content delivery and security.
3. Not Medical or Professional Advice
Mulbyul does not provide medical diagnosis, treatment, prevention, rehabilitation, emergency response, oxygen deficiency detection, blackout prediction, professional coaching, or diving instruction. App guidance, routines, records, heart rate information, and AI-generated results do not replace advice from physicians, medical professionals, certified freediving instructors, or safety supervisors.
Users with cardiovascular conditions, respiratory conditions, high or low blood pressure, a history of fainting or seizures, panic or anxiety symptoms, pregnancy, recent surgery or injury, medication use, or other health concerns should consult a medical professional or qualified expert before using Mulbyul.
4. Prohibited Use Environments
- In water, pools, bathtubs, beaches, dive boats, diving sites, waterfront areas, or any place with drowning or delayed rescue risk
- While driving, riding a bicycle or scooter, operating machinery, cooking, working, or in any situation where distraction may cause an accident
- At heights, on stairs, roads, while walking or running, or any place with fall, collision, or drop risk
- When alone or where no nearby person can check the user's condition and help immediately
- When alcohol, drugs, extreme fatigue, lack of sleep, dehydration, illness, pain, or stress makes the user's condition unstable
- As a safety decision tool for actual freediving or underwater activity without professional training, a safety partner, and rescue procedures
5. When to Stop Immediately
- Dizziness, blurred vision, confusion, headache, nausea, excessive anxiety, fear, or impaired judgment
- Chest pain, palpitations, difficulty breathing, unusual breathlessness, numbness, or abnormal sensation in lips or fingertips
- Feeling faint, loss of balance, body tremors, or an uncontrollable urge to breathe
- An unsafe environment or no other person available to check the user's condition
- Unexpected behavior of the app timer, heart rate display, voice or haptic feedback, or Apple Watch integration
If any of these symptoms occur or injury, fainting, breathing difficulty, or impaired consciousness is suspected, the user must stop training immediately and seek emergency or medical help when necessary.
6. Limits of Routines, Timers, and Records
Mulbyul routines, timers, step target durations, actual progress durations, contraction or hold times, completion state, and record charts are tools to support training. They may differ from actual training because of device state, OS state, app state, battery, background limitations, notifications, Apple Watch connection, HealthKit permissions, or user operation errors.
Users must prioritize their physical condition and surroundings rather than relying solely on app counts, timers, alerts, heart rate display, or records. Records are training logs and reference materials only and are not guaranteed proof of health or safety status.
7. AI Routine Generation
AI routine generation is a support feature that creates dry-training routine suggestions based on the user's request. Generated results may be inaccurate or unsuitable for the user's health condition, training experience, sleep or fatigue level, or safety environment.
Users must review AI-generated routines before following them, and should modify or avoid them if they seem uncomfortable or excessive. The company does not guarantee the accuracy, safety, completeness, timeliness, fitness for a particular purpose, training results, or accident prevention of AI-generated results.
Users must not enter diagnoses, treatment records, medication information, government identification numbers, contact information, or third-party personal information in the AI input field.
8. HealthKit, Apple Watch, and Heart Rate
If the user grants permission, Mulbyul may display or record certain data such as heart rate, workout sessions, and workout duration through Apple Watch or HealthKit. This information is reference material and not a real-time monitoring device for medical or safety decisions.
Apple Watch and HealthKit do not definitively detect hypoxia, blackout, fainting, drowning risk, or the need to stop training, and they do not guarantee rescue requests. Users must stop training immediately if they feel discomfort or danger even when heart rate appears normal.
Mulbyul does not use HealthKit or Apple Watch data for advertising, marketing, tracking, data sale, or health data mining.
9. iCloud and CloudKit
Mulbyul routines and session records sync through iCloud/CloudKit when the user's Apple account, iCloud settings, OS state, and app feature support conditions are met. iCloud, CloudKit, Apple accounts, network, and OS policies are provided and operated by Apple.
The company cannot control or guarantee interruptions, delays, policy changes, account restrictions, sync conflicts, backup failures, unrecoverable data, or record inconsistencies across devices in Apple services. Users should directly check important records and manage device and Apple account security.
10. User Input and Notes
Free-entry areas such as routine titles, descriptions, session notes, and AI input must not include diagnoses, treatment details, government identification numbers, financial information, third-party personal information, unlawful content, or content that infringes third-party rights.
Users are responsible for the accuracy, legality, retention necessity, and third-party rights implications of their own input. To the extent permitted by applicable law, the company limits liability for disputes arising from user-entered content.
11. User Responsibility and Assumption of Risk
- Users must check their own health condition, training experience, sleep or fatigue level, surroundings, and the presence of a companion or supervisor.
- Users must not use Mulbyul as a tool for actual underwater activity, safety decisions, rescue requests, medical decisions, or emergency response.
- Users must treat routines, timers, records, heart rate display, and AI results as reference materials only and stop immediately if they determine there is danger.
- Users must comply with applicable laws, App Store policies, Apple platform terms, and safety rules of freediving education organizations or facilities.
- If the user's breach of these Terms, prohibited environment use, careless training, inaccurate input, or unlawful act causes damage to the company or a third party, the user may be responsible under applicable law.
12. Minors
If a minor uses Mulbyul, a guardian must review the user's health condition, training intensity, app settings, HealthKit and iCloud permissions, training location, and supervision status. Children under 14 must not enter personal or sensitive information without guardian management and consent.
13. Service Changes, Suspension, and Errors
The company may change, restrict, or suspend some Mulbyul features for improvements, security, operational needs, laws, or platform policy changes. Where possible, material changes will be announced through the app, website, or App Store information.
Free features, external-platform-dependent features, and beta or experimental features may change without prior notice. The company does not guarantee that the service will always be error-free, uninterrupted, or identical across all devices and OS versions.
14. Third-Party Services and Platforms
Mulbyul may operate with Apple platform features such as iOS, watchOS, HealthKit, Apple Health, Apple Watch, iCloud, CloudKit, the App Store, and Apple device functions. Apple's terms, privacy policies, account settings, OS restrictions, and device limitations apply to those features.
The company does not guarantee the availability, accuracy, security, policy changes, account restrictions, data recoverability, or device compatibility of services provided by Apple or other third parties.
The Web app is subject to browser and Cloudflare policies, while Google Play and Google-service policies may apply to Android and Wear OS. Platform-specific features and data handling are described in the Privacy Policy.
15. Intellectual Property
Rights related to the Mulbyul app, screen structure, documents, brand, logo, code, design, text, and routine presets belong to the company or the rightful owner. Users may use the service only within the scope required to use the app and must not copy, distribute, modify, reverse engineer, or commercially exploit it without authorization.
16. Disclaimer of Warranties
Mulbyul is provided as is to the extent permitted by applicable law. The company does not guarantee that Mulbyul is suitable for the user's health condition, produces any specific training effect, prevents safety incidents, always provides accurate heart rate or records, always preserves or syncs data, or provides safe or appropriate AI results.
The company also does not guarantee that browser storage or manual backup files will always persist or restore across every version and platform.
17. Limitation of Liability
To the extent permitted by applicable law, the company limits liability for indirect, special, consequential damages, data loss, and lost expected profits arising from use or inability to use Mulbyul, use in prohibited environments, the user's health condition, training method, errors in routines, timers, heart rate, records, or AI results, HealthKit or iCloud integration failure, device, OS, or network conditions, user-entered notes, or third-party service issues.
However, liability caused by the company's intent or gross negligence, and liability that cannot be excluded or limited under applicable law, will be governed by applicable law. Nothing in these Terms shall be interpreted as unfairly excluding or limiting statutory consumer rights.
18. Dispute Prevention and Response
If an issue occurs regarding an accident, record error, data loss, rights infringement, terms violation, or safety notice violation, contact us as soon as possible. Providing the app version, OS version, device model, Apple Watch model, occurrence time, related screens, routine used, session record, HealthKit or iCloud permission status, and reproduction steps helps us investigate.
The company may review relevant logs, inquiry history, published terms and policy versions, and materials provided by the user for inquiries and dispute response. The company and user will first attempt to resolve disputes through good-faith discussion. Disputes not resolved by discussion will follow the jurisdiction standards set by Korean law and civil procedure laws.
19. Changes to Terms
The company may change these Terms according to laws, platform policies, service features, or operational needs. For material changes, the effective date, changes, and reasons may be announced through the app, website, or other appropriate means. Users who do not agree to changed Terms may stop using the app.
